This Privacy Statement discloses the information gathering and dissemination practices of Stand By Systems II, Inc. (“SBS”) in connection with the World Wide Web site located at www.StandBySystems2.com and all other World Wide Web sites owned or operated by SBS (collectively, the “Site”).  The Site is controlled and operated by SBS from its offices in the United States.  This Privacy Statement addresses only SBS’s practices regarding information collected directly from the Site – it does not address or govern any information gathering or dissemination practices related to information collected by way of other means or media, off-line or otherwise.  SBS can be contacted by:

1.  Collection of Personal Information from Site Visitors.  At this web site SBS does not actively seek to collect information about or to identify any individual visitor as we are committed to maintaining the privacy and security of the personal information of all visitors, with the exception of investigating security breaches or in cooperation with authorities pursuant to a legal matter.  However, SBS may passively collect and track (1) the home server domain names, e-mail addresses, type of client computer, files downloaded, search engine used, operating system, and type of Web browser of visitors to the Site, (2) the e-mail addresses of visitors that communicate with SBS via e-mail, (3) information knowingly provided by the visitor in online forms, e-mail, and other online avenues (including, among others, demographic and personal profile data), and (4) aggregate and user-specific information on which pages visitors access.

2.  Use of Personal Data Collected.  By providing SBS with personal identifiable information you have agreed to Opt-In and are in agreement with the terms and conditions set forth in this Privacy Statement on the usage of that information.  Personal data collected by SBS may be used by SBS for many reasons, for example, for editorial and feedback purposes, for marketing and promotional purposes, for a statistical analysis of users’ behavior, for fulfillment of a requested transaction or recordkeeping, to contact Site visitors regarding changes to this Privacy Statement or other online materials, or to customize or improve the content and layout of the Site.  Individually identifying information, such as names, postal and e-mail addresses, phone numbers, and other personal information which visitors voluntarily provide to SBS may be (i) added to SBS databases and used for future calls and mailings regarding Site updates, new products and services, and upcoming events, or (ii) provided to third parties who provide products and services which SBS believes that visitors may be interested in purchasing or obtaining.  Personal data may be disclosed or distributed to another party with which SBS enters or reasonably may enter into a corporate transaction, such as, for example, a merger, consolidation, acquisition, or asset purchase.  Personal data may be retained, used, disclosed, or distributed in an identifiable manner or on an aggregate basis.

3.  Disclosure of Personal Data to Third Parties.  Any third party to which SBS shares, rents, sells, or otherwise discloses or distributes personal data is an independent third party over which SBS exercises no control, and, therefore, SBS is not responsible for any third party’s conduct, products, or services, and will not be liable therefore.

4.  Security Measures.  SBS has implemented security features to prevent the unauthorized release of or access to personal information.  For example, a separate database server is used in connection with the collection of personal information.  Please be advised, however, that the confidentiality of any communication or material transmitted to or from SBS via this Site or e-mail cannot be guaranteed.  Accordingly, SBS is not responsible for the security of information transmitted via the Internet.  For more private communication, visitors to the Site can contact SBS by telephone, or regular mail at the numbers and addresses set out in the beginning of this Privacy Statement.

5.  Opt-Out Right.  Except as necessary for SBS to provide the services or products requested by a visitor, the visitor may opt out of having his or her personally identifiable information, which has been voluntarily provided to SBS through an online form, retained by SBS, disclosed by SBS to third parties, or used for any other purpose by SBS, by contacting SBS via postal mail, e-mail, or facsimile at the addresses set out in the beginning of this Privacy Statement.  (This does not apply to collection of the type of Web browser of the visitor to the Site or to information provided or collected that does not meet the above description.)

6.  Access to and Ability to Correct Personal Data.  Upon a visitor’s request via postal mail, e-mail, or facsimile, SBS will provide to the visitor a summary of any personally identifiable information retained by SBS regarding the visitor, which information has been voluntarily provided to SBS through an online form.  A visitor may modify, correct, change or update such personally identifiable information by contacting SBS via postal mail, facsimile, or e-mail at the addresses set out in the beginning of this Privacy Statement.

7.  Right to Change Privacy Statement.  SBS reserves the right to change this Privacy Statement at any time.  Notice of any new or revised Privacy Statement, as well as the location of the new or revised statement, may be posted on the Site for at least 30 days after the change.  It is the obligation of users visiting the Site before the change to learn of changes to the Privacy Statement since their last visit.  Any change to this Privacy Statement shall be effective as to any visitor who has visited the Site before the change was made.
